The Digital Millennium Copyright Act (“DMCA”) is designed to protect content creators from having their work copied and published by others on the internet. Tech Cyber News respects the intellectual property of others and expects its visitors, writers, and contributors to do the same.
This DMCA Policy applies to the https://techcybernews.com/ website (“Website” or “Service”) and its related content (collectively, “Services”). It explains how the Website operator (“Operator”, “we”, “us” or “our”) handles copyright infringement notifications and how you (“you” or “your”) can submit a copyright complaint.
It is our policy to respond promptly to clear notifications of alleged copyright infringement that comply with the Digital Millennium Copyright Act of 1998, the text of which can be found on the U.S. Copyright Office website.
What to Consider Before Submitting a Complaint
If you are unsure whether the material you are reporting is actually infringing, you may wish to contact an attorney before filing a notification with us.
The DMCA requires you to include your personal information in the notification. If you are concerned about the privacy of your personal information, please take that into account before submitting.
Our Content
Tech Cyber News publishes news, reviews, and guides about technology and cybersecurity. We aim to publish original writing and to use images that we own, have permission to use, or that are available under a suitable license. Our articles may quote short excerpts from company statements, reports, and other sources for reporting, commentary, and criticism, with credit and a link where possible. If you believe any text, image, or other material on our Website infringes your copyright, please contact us using the process below.
Notifications of Infringement
If you are a copyright owner, or an agent of one, and you believe that material on our Services infringes your copyright, you may send us a written notification (“Notification”) using the contact details below. To be valid under the DMCA, your Notification must include:
- Your physical or electronic signature (or that of the person authorized to act for the copyright owner).
- A description of the copyrighted work you claim has been infringed, with a link to the original if available.
- The exact URL(s) of the material on our Website that you claim is infringing.
- Your name, address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your Notification is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Filing a DMCA complaint starts a defined legal process. Your complaint will be reviewed for accuracy, validity, and completeness. If it meets these requirements, our response may include removing or restricting access to the allegedly infringing material.
If we remove or restrict access to material in response to a Notification, we will make a good faith effort to contact the person who published it (for example, a guest contributor) and let them know.
We reserve the right to take no action on a Notification that does not meet all the requirements of the DMCA. This process does not limit any other remedies we may have to address suspected infringement.
Please be aware that under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.
Counter-Notification
If you believe your content was removed by mistake or misidentification, you may send us a counter-notification that includes:
- Your physical or electronic signature.
- A description of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed because of a mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal court for your address (or, if outside the United States, any judicial district where we can be found), and that you will accept service of process from the person who filed the original notice.
Send counter-notices to the email below with the subject line “DMCA Counter-Notice.” If we receive a valid counter-notice, we may restore the material within 10 to 14 business days unless the original complainant informs us that they have filed a court action.
Guest Posts and Contributor Content
Our Write For Us page allows contributors to submit articles. Contributors confirm that their content and images are original or properly licensed and that they have the right to publish them. If a submission is found to infringe someone’s copyright, we will remove it and may stop accepting future submissions from that contributor.
Repeat Infringer Policy
In appropriate circumstances, we will disable access for contributors or users who are found to be repeat infringers of copyright.
Company Names, Images, and Trademarks
Names, logos, and trademarks of companies and products mentioned on this Website belong to their respective owners and are used for identification and editorial purposes only.
